Terms of Service

1. Acceptance of Terms

By creating an account or using Purely, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

If you are under 18, your parent or guardian must have provided verifiable consent before you use Purely.

2. Eligibility

• You must be at least 13 years old to use Purely.
• Users aged 13–17 require parental or guardian consent.
• You must provide accurate information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.

3. The Service

Purely provides AI-powered skin tracking tools, including photo analysis, progress logging, skincare routine suggestions, and trigger tracking. These features are for wellness and informational purposes only.

4. User Content & Photos

You retain ownership of photos and data you upload. By uploading content, you grant Purely a limited license to store and process that content solely to provide the service to you. We will never sell your photos or use them without your consent as described in our Privacy Policy.

You agree not to upload:

• Photos of other people without their consent
• Content that is illegal, harmful, or offensive
• Content that violates any third-party rights

5. AI Analysis Disclaimer

Our AI-powered skin analysis uses machine learning to identify patterns in photos. These analyses are not medically validatedand may be inaccurate. Severity scores and acne type classifications are estimates only. Do not make medical decisions based solely on Purely's AI output.

6. Advertising

Free tier users may see advertisements while using Purely. Ads are displayed in designated areas only and will never interrupt active features like skin scanning. Premium subscribers are completely ad-free.

Ad placements are clearly labeled "Advertisement" or "Sponsored." You may dismiss any individual ad for 24 hours. Upgrade to Premium for a permanently ad-free experience.

6b. Free vs. Premium

• Free tier: 2 skin scans per day, 7-day history, 3 product scans per day, 10 Clay messages per day, 2 themes. One small advertisement shown after each scan.
• Premium ($4.99/month): Unlimited scans, full history, all features, all 8 themes, completely ad-free.
• Premium+ ($9.99/month): Everything in Premium plus advanced trigger AI, weekly custom routines, ingredient watchlist, and full data export.

7. Premium Subscriptions

Purely offers Premium ($4.99/month) and Premium+ ($9.99/month) subscription tiers. Both tiers include an ad-free experience and access to advanced features.

• Subscriptions automatically renew until cancelled.
• You may cancel at any time from the Settings page.
• First-time subscribers are eligible for a full refund within 7 days of purchase. See our Refund Policy for details.
• No refund is available after 7 days or for non-first-time subscribers.
• Yearly plans are billed annually and offer a discount over monthly pricing.

8. Virtual Currency

Purely Tokens are virtual currency with no real-world monetary value outside the app. Tokens can be earned through in-app activity or purchased through the Purely Store.

• Purchased tokens are non-refundable.
• Earned tokens cannot be transferred or exchanged for cash.
• Token balances may be forfeited if your account is terminated for violating these terms.

9. Affiliate Disclosure

Some product recommendations in Purely include affiliate links. We only recommend products we believe are beneficial for your skin type. Affiliate relationships do not influence our AI recommendations — sponsored products are clearly labeled "Sponsored."

10. Acceptable Use

You agree not to:

• Use Purely for any unlawful purpose
• Attempt to reverse-engineer or compromise our systems
• Create multiple accounts to circumvent restrictions
• Share your account with others
• Use the app in any way that could harm other users

11. Intellectual Property

All Purely branding, software, and content (excluding your personal data) is owned by Purely and protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without permission.

12. Account Termination

You may delete your account at any time through the Settings page. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted per our Privacy Policy.

13. Limitation of Liability

To the fullest extent permitted by law, Purely shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability shall not exceed the amount you paid us in the past 12 months.

• Purely is not liable for skin reactions, irritation, or adverse effects from products recommended in the app. Always patch test new products before full use.
• Consult a licensed dermatologist or healthcare provider for any serious, persistent, or worsening skin conditions.
• AI-generated analysis is for informational purposes only and does not constitute medical advice.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Virginia.

15. Changes to Terms

We may update these terms. We will notify you of material changes via email or in-app. Continued use of Purely after changes constitutes acceptance of the new terms.
